Regional offices in Hudson Valley and Brooklyn are already in communication, he noted, *raising concern the investigation could expand into Brooklyn as well. He warned that once authorities suspect program funds were obtained or used improperly, they immediately freeze all of an agency's accounts — even when only part of the activity is in question — leaving agencies unable to pay stores regardless of prior commitments. The risk doesn't end there, he said: *if authorities later determine payments were tied to fraud or improper use, stores that already received money could be required to repay it, even years later.*#CLAWBACKS

*Timeline:* A string of funding disruptions played out over recent weeks. In July, on a Friday afternoon, the agency overseeing SCN providers paused payments, initially framed as a one-week hold beginning July 17; in Rockland, providers reportedly have not been paid since. Roughly two weeks ago, a similar disruption hit New York and Staten Island providers — not a full hold, but a requirement that recipients requalify, with payments now covering only one individual per household rather than the full family. Other areas remain active for now, though funding could reportedly be cut off at any time.

According to Adest, the program is intended strictly as an *immediate food-need benefit for those with no other resources to obtain food right now; anyone still holding EBT/food stamp funds would not be eligible, and it isn't meant to stockpile inventory for future months*.

Under the eligibility standard being discussed, he said, only a fraction of families would clearly qualify — and large numbers of participants receiving benefits despite the narrow criteria is itself, in his assessment, a sign the program is being used unlawfully, even if unknowingly.

Askanim say the SCN program began in a manner resembling COVID-era food-box distributions — initially serving postpartum and pregnant women — *before eligibility expanded significantly over time, built around a recruitment structure connecting an approval company and a servicer. End users reportedly received supermarket gift cards or store credit worth up to $800 per week, while the larger sums flowed to the companies distributing the boxes themselves, which competed to enroll more participants; per-box values reportedly climbed from $200–$500 toward a cap near $1,000. Over roughly the past year and a half, offerings expanded from raw food boxes to prepared meal boxes and eventually to toys and small household appliances, with importing and wholesale companies opening specifically to supply the items, many of which are reportedly still owed millions.*

Adest was clear that store owners cannot rely on a claim of innocence alone: if an owner knew, suspected, or saw obvious signs something might be illegal and continued participating anyway, he said, that owner can be held liable under conspiracy or related legal theories, the same as the actual perpetrators of any underlying fraud. *He also raised a separate concern about transparency — that customers may not know what was submitted in their name to obtain approval, and a customer's lack of awareness does not make the underlying transaction safe if false or inaccurate information was submitted.*
